“Cool Cabana Specials!” Competition

- Information on how to enter this competition and other details contained within promotional advertisements or online entry pages for the competition (including the prizes) form part of these Terms and Conditions.
- Participation in this competition is deemed acceptance of these Terms and Conditions.
- This competition will be considered a ‘Trade Promotion Lottery’ in accordance with Regulation 36A and Schedule 5 of the Gaming and Wagering Commission Regulations 1988
- The Promoter is West Cape Howe Wines Pty Ltd (ABN 18 096 205 113) of 14923 Muir Hwy, Mount Barker WA 6324(Promoter).
- The competition commences at 12.00am AWST Saturday, September 23rd, 2023, and closes at 11:59pm AWST Friday, December 15th, 2023 (Competition Period). No late entries will be eligible to enter the competition.
- Entry is open to Australian residents aged 18 years or over who are not employees of the Promoter (or their associated agencies) or an immediate family member of those employees (Eligible Entrant). Eligible Entrants must purchase a min of 12 bottles of either 2022 Mount Trio Sangiovese Rose, and / or 2021 West Cape Howe Pinot Gris and / or 2022 Blonde Crow Rose from the West Cape Howe cellar door or website (Qualifying Entry) Each Qualifying Entry:
- That purchases 12 bottles of wine will automatically receive one (1) entry into the Prize Draw
- An entry that does not, in the opinion of the Promoter, comply with these Terms and Conditions may be disqualified.
- The prize is 1 x Medium CoolCabana, 1 x We Love Summer Adventure Beach Wagon Navy and 1 x Cape Men's Garden Hat One Size Fits Most, total prize valued at $350.)
- The prize draw will be drawn at random for eligible winners, and will be conducted at 14923 Muir Hwy, Mount Barker WA 6324 on Thursday 21st December 2023.
- The winners of the prize, who must be an Eligible Entrant, will be notified via email and phone call once the relevant prize draw has taken place. The Promoter reserves the right to request that the winner provide proof of age and identity prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Promoter. The prize winner may be required to sign any form required by the Promoter including without limitation legal release and indemnity form or a declaration confirming their eligibility to accept the prize.
- The Promoter’s decision will be final and cannot be contested. No correspondence will be entered into. The Promoter reserves the right to limit entry if considered necessary, except in respect of any consent provided by an entrant in accordance with section 19 below.
- If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the relevant prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- The Promoter reserves the right, at any time, to verify the validity of entries by entrants and to disqualify any entrant who manipulates the system.
- Except for liability that cannot be excluded by law, the Promoter, their associated agencies, and companies (and their respective officers, employees, and agents) exclude all liability (including negligence) for any personal injury, death, expense or any loss or damage (including loss of opportunity or profits, whether direct, indirect, special, or consequential) arising in any way in connection with this competition or any prize/s.
- If for any reason this competition is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in their sole discretion to cancel, terminate, modify, or suspend the competition.
- Prizes may not be sold or offered for resale at a premium (including via-online auction sites) or used for advertising, promotion, or other commercial purposes (including competitions and trade promotions or competitions) or to enhance the demand for other goods or services, either by the original recipient or any subsequent bearer. If a prize is sold or used in breach of this condition the prize may be withdrawn.
- In the event that they are a winner, Eligible Entrants consent to the Promoter, in accordance with its privacy policy, using the Eligible Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition and for any other purpose at the Promoter and Sponsor’s sole discretion.
- By participating in this competition entrants agree to provide the entrant’s personal information to the Promoter, in accordance with its privacy policies, the Promoter using and disclosing the entrant’s personal information for the purposes of conducting the competition, redeeming the Prizes and any other matter connected to or incidental to this competition. Entrants consent to their information being used by the Promoter and their related companies for the purposes of carrying out marketing, planning, product development and competition campaigns in any media including email and SMS.
- All personal information that an entrant provides to the Promoter in connection with this competition will be used and may be disclosed by the Promoter (including for promotional and marketing purposes) in accordance with their Privacy Policies available at: ww.westcapehowewines.com.au/Legal/Privacy
- By providing your personal information you agree to such use.
- By entering this competition, the entrant confirms that it has read the privacy policies as referred to in sections 19 of these Terms and Conditions.
- These Terms and Conditions shall be governed by the laws of Western Australia and subject to the exclusive jurisdiction of Western Australian courts.
